Terms of Use
Last updated: October 2026 – Version 3.0
1. Introduction and nature of the service
1.1. Description of the service. AI Psychologist is a technology platform that uses artificial intelligence to provide information, guidance and resources related to psychological and emotional well-being. We offer automated conversation services, educational resources and self-help tools based on recognised psychological principles.
1.2. Nature of the service – virtual well-being assistant. AI Psychologist acts exclusively as a virtual emotional well-being assistant supported by artificial intelligence technology. Its purpose is informative, educational and general well-being support. The answers, suggestions and recommendations provided are intended to complement the user's knowledge of mental well-being topics, but they are not intended to, and cannot, replace the professional judgement of psychologists, psychiatrists or any other suitably qualified and licensed mental health professional.
1.3. Not a medical or professional psychological service. AI Psychologist is NOT a medical service, a professional psychological service or a clinical diagnosis service. We do not provide medical diagnoses, professional psychological treatment, prescriptions or specific medical advice. Any information provided should be considered general educational guidance and not personalised professional advice or therapeutic treatment.
1.4. Artificial intelligence technology. Our services are based on artificial intelligence algorithms that process information and provide automated answers. Although we use advanced technology, the user must understand that this is an automated system with the limitations inherent to this technology, and that at no time is the user interacting with a mental health professional.
2. What AI Psychologist is not and does not do
To ensure a clear understanding of the scope of the service, it is expressly stated that AI Psychologist is not, does not carry out and cannot carry out any of the following activities:
| AI Psychologist is NOT… | Explanation |
|---|---|
| A clinical diagnosis | The system does not assess, diagnose or determine the presence of any mental health disorder, illness or condition. No answer from the platform is a medical or psychological diagnosis. |
| Psychotherapy | No therapeutic intervention of any kind is carried out. Conversations have no therapeutic value and are not equivalent to sessions of psychology, psychiatry, clinical coaching or any other form of professional treatment. |
| Medical prescription | The platform does not prescribe, recommend or suggest medicines, doses or drug treatments of any kind. |
| Clinical risk assessment | The system does not assess the risk of suicide, self-harm or any other clinical risk. In a crisis, the user must contact a professional immediately. |
| A therapeutic relationship | There is no therapeutic relationship between the user and the platform or between the user and any professional. Interacting with the AI system creates no clinical rights or obligations. |
| An emergency service | AI Psychologist is not a crisis or psychological emergency service. It must not be used in life-threatening situations or psychiatric emergencies. |
| Expert evidence or report | The conversations and answers generated by the system have no validity as a psychological report, expert assessment, certificate or official document of any kind. |
2.1. Name of the service. For the purposes of these Terms and any official communication, AI Psychologist is defined as an AI-based virtual emotional well-being assistant. The trade name of the platform is used for identification purposes only and does not imply the provision of regulated professional psychological services.
3. Access to the website and conditions
3.1. Access to the website. Some areas of this website are open to the general public and can be visited without registering any personal data. However, to access the full AI Psychologist services, users must complete the registration process.
3.2. Services. Users can explore the different features available on the platform. To access the full Services, users must register by providing the information requested and accepting these Terms.
3.3. Acceptance. By accessing, registering and using the services, users accept these Terms. Users who do not accept them during registration will not be able to access the Services.
3.4. Review of the Terms. AI Psychologist may review these Terms at any time. Users will be notified of substantial changes. Users are bound by the Terms in force at the time they use the services.
3.5. Responsibility. Users are solely responsible for doing whatever is necessary to access the website, for making sure they access it securely, and for knowing, complying with and accepting these Terms.
4. How to register
4.1. Registration. To access the full services, users must complete the registration form, which asks for basic identification data (such as a username, email address and password). Please check the information you enter and correct any errors before completing registration.
4.2. Verification. Once registration is complete, the user will receive a confirmation at their email address and must follow the instructions to activate the account.
4.3. Account responsibility. Users are responsible for keeping their login details confidential and for all activity carried out under their account, and must report any unauthorised use of their account immediately.
5. Important limitations and safety recommendations
5.1. Emergencies and crisis situations. In the event of a psychological crisis, suicidal thoughts, self-harm, thoughts of harming others, or any situation requiring immediate medical or psychological attention, users must contact the following services immediately and must NOT continue using this platform:
- Emergency services: call 112 from a cellphone or 10177 for an ambulance.
- SADAG Suicide Crisis Helpline: 0800 567 567 (24 hours, toll-free).
- The emergency department of the nearest hospital.
- Your doctor or mental health professional.
5.2. Express recommendation to consult a professional. We strongly recommend that any important decision related to mental health, psychological treatment, medication or significant lifestyle changes is discussed with a suitably qualified and licensed mental health professional. AI Psychologist may suggest when it is appropriate to seek professional help, but the final responsibility for seeking that help lies solely with the user.
5.3. Technical limitations of artificial intelligence. AI systems have inherent limitations, including but not limited to:
- Limited understanding of complex emotional contexts.
- Inability to detect non-verbal signals.
- Lack of clinical intuition and practical experience.
- Dependence on patterns in previous data.
- Possible misinterpretation of specific situations.
- Inability to establish a real therapeutic relationship.
- Answers may not reflect the latest scientific knowledge.
5.4. Conditions that require immediate professional attention. Users must seek professional help immediately if they experience:
- Thoughts of suicide or self-harm.
- Symptoms of psychosis or loss of contact with reality.
- Substance abuse.
- Severe eating disorders.
- Recent trauma or post-traumatic stress.
- Domestic violence or abuse.
- Any condition that significantly interferes with daily functioning.
6. Confidentiality of conversations
General principle. Conversations on the platform are strictly confidential. AI Psychologist undertakes to treat the content of users' interactions with the highest level of privacy and protection, in accordance with the GDPR and the LOPDGDD.
6.1. Confidential nature of conversations. The content of the conversations that users have with the AI Psychologist AI assistant is considered confidential information. No third party, individual or company, outside the technical operation strictly necessary for the service will have access to the content of those conversations.
6.2. Restricted access – who can and cannot see conversations:
| Who | Access to content | Condition |
|---|---|---|
| The user | Yes | Always, from their authenticated account. |
| External third parties (individuals, companies) | No | Prohibited in any ordinary circumstance. |
| AI Psychologist operational staff | No | Staff do not routinely access the content of conversations. |
| Authorised technical team | Only under a strict protocol | Only in the cases listed in clause 6.3. |
| Competent authorities | Only under a legal requirement | Only following a court order or valid legal requirement under Spanish law. |
6.3. Technical audit in the event of a platform incident. Exceptionally and on a restricted basis, the authorised technical team of AI Psychologist may access the content of conversations only in the following cases:
- Serious technical failures of the platform affecting the integrity, security or proper functioning of the service.
- Security incidents or data breaches that require review to contain the damage and inform those affected.
- Critical errors of the AI system that may have generated potentially harmful or incorrect answers.
- Compliance with legal reporting obligations to the Spanish Data Protection Agency (AEPD) in the event of a security breach.
Safeguards of the audit process:
- Access is restricted to technical staff with express authorisation and a justified need to know.
- Each access is recorded in an internal log stating the person, date, time, reason and conversation(s) consulted.
- Access is proportionate to the incident and limited to the minimum necessary in scope and duration.
- The affected user will be notified as soon as technically possible, unless a legal confidentiality obligation temporarily prevents it.
- The information consulted is subject to a strengthened duty of secrecy and may not be used for any purpose other than resolving the incident.
6.4. Use of data to improve the service. If AI Psychologist uses conversation data in anonymised and aggregated form to improve its models or the service, users will be informed and their express and unambiguous consent will be obtained in advance, in accordance with article 6 GDPR. Users may withdraw that consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
6.5. Deleting your conversation history. Users have the right to request the deletion of their conversation history at any time, without prejudice to any minimum retention period required by law. The request can be made from the account settings or by writing to support@psicologoia.ai.
7. Responsible use and user obligations
7.1. Truthful and accurate information. Users undertake to provide truthful, accurate and up-to-date information. The quality of the answers given by AI Psychologist depends largely on the accuracy of the information provided.
7.2. Personal, non-commercial use. The services are intended exclusively for the personal use of the registered user. Commercial use, resale or any form of commercial exploitation of the services is prohibited.
7.3. Specific prohibitions. It is expressly prohibited to use the service to:
- Obtain diagnostic or therapeutic information about third parties without their express consent.
- Try to diagnose, treat or advise other people based on the information obtained.
- Carry out illegal activities or activities that may harm third parties.
- Impersonate others or deliberately provide false information.
- Try to access restricted areas of the system or breach security measures.
- Use the service in an automated or mass way through bots or similar systems.
7.4. Critical evaluation. Users acknowledge the importance of critically evaluating all information received and undertake to check it against other sources when appropriate.
7.5. Responsibility for decisions. Users acknowledge that they alone are responsible for the decisions they make based on the information provided by AI Psychologist.
8. Privacy and data protection
8.1. Applicable rules. The processing of personal data is governed by our Privacy Policy, in full compliance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).
8.2. Data controller. The controller of users' personal data is the owner of the AI Psychologist platform, CEDIA Investigación y Desarrollo, S.L. (NIF B93806404, Av. Aragón 30, 46021 Valencia, Spain), whose full details appear in the Legal Notice. For any question about data processing, write to support@psicologoia.ai.
8.3. Special category data – health data (art. 9 GDPR). Conversations on this platform may contain information about the user's emotional, psychological or mental health. The GDPR classifies such data as a special category (health data, art. 9.1 GDPR), which requires a higher level of protection.
The legal basis for processing this data is the user's explicit consent (art. 9.2.a GDPR), given freely, specifically, in an informed and unambiguous way at registration through a separate checkbox. Users may withdraw this consent at any time, without affecting the lawfulness of previous processing.
AI Psychologist does not use this data to make clinical decisions or diagnoses, and does not share it with health systems, insurers, employers or unauthorised third parties.
8.4. Data processor – Anthropic, PBC. To provide the AI conversation service, AI Psychologist uses the API of Anthropic, PBC (Claude model). Under article 28 GDPR, Anthropic acts as processor of the data that users enter in conversations, while AI Psychologist acts as controller.
The relationship with Anthropic is governed by its Data Processing Addendum (DPA), which includes the Standard Contractual Clauses (SCCs) approved by the European Commission as the mechanism for international data transfers (modules 2 and 3). Anthropic undertakes to process the data only on the controller's instructions and not to use it to train its models unless expressly authorised.
8.5. International data transfers. Anthropic, PBC is based in San Francisco, California (USA). Processing conversations may involve an international transfer of data outside the European Economic Area. This transfer is carried out under the Standard Contractual Clauses adopted by the European Commission (Implementing Decision 2021/914), included in Anthropic's current DPA. Since August 2025, Anthropic has infrastructure in several regions (USA, Europe, Asia and Australia) to improve the reliability of the service.
8.6. Sub-processors. AI Psychologist informs users that the following main providers act as sub-processors in the provision of the service:
| Provider | Function | Location | GDPR safeguards |
|---|---|---|---|
| Anthropic, PBC | Processing of conversations (Claude AI model) | USA / multi-region | DPA + SCCs (art. 46 GDPR) |
| Hosting provider | Platform infrastructure and hosting | See Privacy Policy | Signed DPA |
| Payment gateway (Stripe) | Processing of payments and subscriptions | USA / EU | DPA + SCCs |
| Email provider | Transactional communications and notifications | See Privacy Policy | Signed DPA |
Users accept that AI Psychologist may use sub-processors to provide the service, provided they are bound by equivalent data protection obligations. Users will be informed sufficiently in advance of any substantial change to the list of sub-processors.
8.7. Data retention by Anthropic. In accordance with Anthropic's policy for API customers, conversation inputs and outputs are deleted from Anthropic's servers within a maximum of 30 days of receipt or generation, unless a legal or technical exception applies (for example, if the conversation is flagged by abuse detection systems, in which case retention may be extended to up to 2 years). Anthropic does not use API data to train its AI models by default.
8.8. Data retention by AI Psychologist. Account data (username, email) is kept for as long as the contractual relationship lasts and, once it ends, for the periods required by law. The conversation history stored on the platform is kept while the user's account remains active, unless early deletion is requested. Billing data is kept for the period required by tax law (at least 5 years).
8.9. Minors. The service is intended exclusively for people aged 18 or over. People under 18 may not register or use the service. Under article 7 of the LOPDGDD, processing the data of children under 14 requires the consent of their parents or legal guardians. By registering, users expressly declare that they are 18 or over. If AI Psychologist becomes aware that a user is a minor, it will immediately close the account and delete the data.
8.10. Automated decisions. The service generates answers through automated processing of the information provided by the user. Under article 22 GDPR, users have the right not to be subject to decisions based solely on automated processing that produce legal effects or significantly affect them. In the context of this service, the assistant's answers are for information only and are not binding decisions. Users always keep full autonomy over their personal decisions. Users who wish to request human review of an interaction can write to support@psicologoia.ai.
8.11. User rights. Users may exercise the following rights against AI Psychologist as controller at any time:
- Access: confirmation of whether their data is being processed, and access to it.
- Rectification: correction of inaccurate or incomplete data.
- Erasure ("right to be forgotten"): deletion of their data when it is no longer necessary for the purposes for which it was collected.
- Restriction of processing: suspension of processing in certain cases.
- Portability: receiving their data in a structured, commonly used format.
- Objection: objecting to the processing of their data in certain cases.
- Withdrawal of consent: at any time, without affecting the lawfulness of previous processing.
- Complaint to the AEPD: users who consider that the processing does not comply with the law can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
To exercise any of these rights, write to support@psicologoia.ai stating the right you wish to exercise and attaching a copy of your identity document.
8.12. Cookies. Please read our Cookie Policy to find out how and why we use cookies to improve the quality of the website and of the service.

12. Availability and changes to the service
12.1. Availability. We strive to keep the service available 24/7, but we do not guarantee continuous availability because of maintenance, updates, technical failures or force majeure.

19.2. No-refund policy. Because AI Psychologist offers a free trial before any paid plan is purchased, refund requests will not be accepted once the subscription has been paid. By purchasing a paid plan, the user acknowledges that they have had the opportunity to evaluate the service free of charge and that they pay with full knowledge of the features, functions and limitations of the platform.

In accordance with article 103.m) of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users, the user expressly agrees that the supply of digital content begins immediately after payment is confirmed, and therefore waives the right of withdrawal, since the service begins with the user's express consent.
